Company Liquidation
What Is It?
Company liquidation falls into two distinct categories, insolvent liquidations generally referred to as ‘Creditors Voluntary Liquidations’ and solvent liquidations generally referred to as ‘Members Voluntary Liquidations’.
Is It Right For My Business?
Generally speaking your company is insolvent if it is unable to pay its debts as they fall due. Your company can also be insolvent if the company’s balance sheet indicates its liabilities exceed its assets. If in your case these tests apply then the type of company liquidation you would need to consider is a ‘Creditors Voluntary Liquidation’
Company directors are often advised that they should seek a Members Voluntary Liquidation. This is a procedure where surplus assets are available to the company’s shareholders/members, after paying in full all of the company’s creditors.
Both types of company liquidation require a Licensed Insolvency Practitioner to act as Liquidator.
